Most homeowners don’t find out how their builder’s warranty really works until something goes wrong. By then, the wrong conversation with the wrong person can end up costing them the claim.

RSN Law construction attorney Robert P. Rutila joined Preppy Jarhead’s podcast, “How Builders Avoid Paying Warranty Claims (Attorney Reveals Everything),” to break down the tactics builders use to get out of warranty obligations and what Arizona homeowners can do to stay a step ahead.

A few of the biggest takeaways for homeowners:

  • Record everything. Conversations with sales reps, builder representatives, and repair crews are your best protection if a promise later gets denied.
  • Don’t skip an independent inspection. If a builder suggests you don’t need one before closing, that’s exactly when you need one most.
  • If you file an Arizona Registrar of Contractors complaint, document every defect, not just the obvious one. A thin complaint is an easy one to dismiss.

Asked about the attorney’s role in these disputes, Rutila put it simply: “A good lawyer has to know both sides of the argument… The superpower is, I guess, seeing both sides of the argument, being able to counter. It’s a chess match.”
